1. Agreement to Terms

By accessing or using PayMind ("Service"), operated by BizMind AI Agency LLC ("Company", "we", "us"), you agree to be bound by these Terms and Conditions. If you do not agree, do not use the Service.

2. Service Description

PayMind is a payment collection platform designed for Buy Here Pay Here (BHPH) auto dealers. The Service facilitates automated payment collection, payment reminders, delinquency management, and customer communication on behalf of participating dealers.

3. Dealer Terms

  • Dealers must maintain an active subscription ($2,000/month) to use the Service.
  • Dealers are responsible for the accuracy of customer information entered into the system.
  • Dealers must ensure they have proper consent from customers to collect payments and send communications.
  • Dealers must comply with all applicable federal, state, and local laws regarding auto financing and debt collection.
  • Payment funds are deposited directly into the dealer's connected Stripe account.

4. Customer Terms

  • Customers access the Service through their dealer's PayMind account.
  • By signing a loan agreement with a participating dealer, customers consent to receive payment-related communications from PayMind.
  • Customers can access their payment portal via secure magic links sent by SMS or email.
  • Payment methods saved on the platform are stored securely by Stripe, a PCI-compliant payment processor.

5. SMS/Text Messaging Program

Program Name: PayMind Payment Notifications

Description: Transactional account notifications including payment reminders, past-due notifications, payment confirmations, and secure account access links for existing dealership customers.

Consent: Customers provide explicit SMS consent through the PayMind customer portal via a clearly displayed consent checkbox during account registration. Consent is not required to access dealership services. Full consent details are available at our SMS Consent page.

Message Frequency: 2-6 messages per month depending on payment schedule and account status. No promotional or marketing messages are sent.

Message and Data Rates: Message and data rates may apply. Check with your mobile carrier for details.

Opt-Out: You can stop receiving SMS messages at any time by replying STOP to any message. You will receive a confirmation message and no further SMS messages will be sent. This does not affect your payment obligations.

6. Payments and Billing

  • All payment processing is handled through Stripe.
  • PayMind does not store credit card numbers or bank account details.
  • Dealer subscription fees are billed monthly via Stripe Billing.
  • Customer loan payments are processed and deposited directly to the dealer's bank account via Stripe Connect.
  • Standard payment processing fees apply as determined by Stripe.

7. Data Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your information.

8. Limitation of Liability

PayMind is a payment facilitation tool. We are not a lender, financial institution, or debt collector. We do not make lending decisions, set loan terms, or determine collection actions. The dealer is solely responsible for their lending practices and compliance with applicable laws.

To the maximum extent permitted by law, BizMind AI Agency LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of the Service.

9. Termination

We reserve the right to suspend or terminate access to the Service for violation of these Terms, non-payment of subscription fees, or any activity that we determine to be harmful to the Service or other users.

10. Changes to Terms

We may modify these Terms at any time. Changes will be effective when posted to this page. Continued use of the Service after changes constitutes acceptance of the modified Terms.

11. Governing Law

These Terms shall be governed by the laws of the State of Texas, without regard to conflict of law provisions.
